Brown also said in an alarming survey I conducted over the past 5 years of 5,000, we found that only 2 out of 100 people were actually read the required verbal oath when swearing an affidavit before Notary NYS. This is a critical flaw in our system because it would be 98% of all notarial acts invalid and unenforceable thereafter. At the root of this problem is the fact that once licensed as a notary by the Secretary of State authority, the Division of Licensing Services, NYS does not require training and the lawyer forgets merely their legal procedures. It is recommended to Brown that the statutes of the State to adopt new ones that require continuing education to fix the flaw in our system.
